These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or “your”), and MIBE Tribe LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of the website themibe.com, as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site” or “Services”).

You agree that by accessing the Site or Services, you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. Agreement to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Site after the date such revised Terms are posted.

By using the Site, you represent and warrant that:

You may be able to contribute content to the Site (e.g., comments, reviews, or submissions). By posting any User Content, you grant us a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any form.

You represent that your User Content does not violate any third-party rights and is not unlawful, threatening, abusive, or otherwise objectionable.

5. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

Prohibited activities include (but are not limited to):

  • Using the Site in any manner that could disable, overburden, damage, or impair the Site.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, or any loss of profits or revenues, whether incurred directly or indirectly.

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you to us, if any, in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold us harmless from and against any losses, damages, liabilities, and costs (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your User Content, or your violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Jefferson County, Colorado, and you hereby consent to the personal jurisdiction and venue therein.

10. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

SMS/Text Messaging Terms and Conditions

In addition to the above general Terms, the following specific terms apply to our SMS/text messaging program.

By opting in to receive text messages from MIBE Tribe LLC, you agree to these SMS Terms, which supplement our general Terms of Service.

  • Legal Business Name: MIBE Tribe LLC

  • Program Description / Types of Messages: We may send recurring SMS/MMS messages containing marketing promotions, exclusive deals and discounts, order and shipping notifications, appointment reminders, account updates, and other information related to our products and services.

  • Message Frequency: Message frequency varies. You may receive several messages per month, depending on your interaction with our services.

  • Message and Data Rates: Message and data rates may apply. Please consult your wireless carrier for details on applicable rates and charges.

  • Opt-Out Instructions: You can cancel the SMS service at any time by texting STOP, QUIT, CANCEL, or UNSUBSCRIBE to the number from which you received the message. After you send the opt-out message, we will send you a confirmation that you have been unsubscribed. You will no longer receive SMS messages from us after this point.

  • Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.

  • Consent: Consent to receive SMS is not required as a condition of purchasing any goods or services. You may opt in via our website forms, by texting a keyword (such as START) to our number, or through other explicit methods.
